Below you will find the terms and conditions for both entering the Open Banking Expo Awards, and for booking to attend the Open Banking Expo Awards event. Please make sure you have read these before submitting an entry or making a booking.

TERMS & CONDITIONS FOR ENTERING

Definitions and Interpretations

1.1. In this Terms and Conditions, unless the context otherwise requires, the following words shall have the following meanings:

“Awards” – means the competition known as the Open Banking Expo Awards whereby Open Banking products and services are judged by our independent panel and awards are given in relation to the Categories;

“Category” – means each particular category within the Awards listed and detailed on the Website;

“Closing Date” – Deadline as conveyed on the Website;

“Entrant” – means an individual or team that submits an Entry for the Awards;

“Entry” – means the material submitted for the Awards by the Entrant;

“Multiple Entries” – means more than one entry per brand;

“Fee” – means the relevant fee payable by the Entrant and / or Attendee for the corresponding Category which is set out on the Website. Fees must be paid in full by the deadline conveyed on the website, entry forms, invoices and booking forms;

“Organisers” – means the team who organise and implement the Awards;

“Rules” – means the terms and conditions set out on the Website and (unless the context otherwise requires) including any special terms and conditions agreed in writing between the Entrant and / or Attendee and the Organisers;

“Website” – means the Awards website accessible at www.openbankingexpo.com/awards

“Winners” – means the winner for each Category.

1.2 The Organisers reserve the right to cancel / amend all or any part of the Awards and / or Rules. Any changes to the Rules or Awards will be posted on the Website. It is the responsibility of the Entrant and / or Attendee to keep themselves informed of any changes.

1.3 By submitting an Entry to the Awards the Entrant and / or Attendee agrees to comply with the Rules.

1.4 In the event of any dispute regarding the Rules, conduct or results of the Awards, the decision of the Organisers shall be final and unchallengeable.

Awards Entrant

2.1. The Awards are open to all Entrants, regardless of location or organisational type.

2.2. By entering the Awards, the Entrant hereby warrants that all information submitted is true, accurate and complete. The Organisers reserves the right to verify any information contained in the Entry and the Entrants eligibility to enter the Awards.

2.3. The Organisers reserve the right to disqualify an Entrant if it has reasonable grounds to believe that an Entrant has breached any of the Rules, any applicable law (any copyright law) or has otherwise infringed the intellectual property of any third party.

2.4. In the event a Winner is disqualified from the Awards, the Organisers will select an alternative Winner in the same manner as the original Winner and such selection will be subject to the Rules.

The Awards

3.1. All Entries must be submitted using the official entry forms. No hardcopy Entries will be accepted.

3.2. Unless otherwise stated, each Entry should focus largely on work completed or projects undertaken during the specified qualifying period, however products developed before this date are not precluded from entering.

3.3. An Entry can be submitted to multiple Categories if relevant.

3.4. An Entrant can submit multiple Entries in the same category only if the Entry is for a different product or service.

3.5. Multiple Entries can be submitted from a single organisation or brand.

3.6. While submitting an Entry, Entrants should supply the Organisers updated and reachable contact details. Any changes to contact details supplied should be emailed directly to the Organisers.

3.7. In case of technical difficulties, Entrants are advised to save a version of the Entry in a saveable document prior to submitting their Entry.

3.8. On receipt of an Entry, the Organisers will confirm its arrival via email. If an Entrant does not obtain such a receipt within three days, it is the Entrant’s responsibility to contact the Organisers to confirm its arrival. Unless confirmation has been received verbally or in writing, the Organisers cannot guarantee the arrival of an Entry.

3.9. Only a fully completed Entry will be accepted. Word limits are to be strictly observed. Judges will only receive the exact number of words requested.

3.10. Amendments cannot be made to an Entry once submitted. If an Entrant has any concerns about information included in an Entry after it has been submitted, they should contact the Organisers directly.

3.11. In the event the Organisers have reasonable grounds to believe an Entrant has attempted to influence the decision of the judges further, by any means outside or in addition to the official Entry, the Entrant will be disqualified.

3.12. All Entries must be submitted in the English language and must be accompanied by the appropriate Fee.

3.13. All Entries must be submitted, and Fees received before the Closing Date. No Entry will go forward for judging unless full payment of the Fee is received.

3.14. The shortlist will be announced in accordance with the date confirmed on the website.

3.15. Final Judging will take place within four weeks of the ceremony or as otherwise decided by the Organisers (see 3.18)

3.16. Winners will be published on the Website.

3.17 All materials will remain confidential to the judges.

3.18 The Organisers will not be held responsible for any claims concerning rights infringement.

Governing Law and Jurisdiction

4.1. The Rules and any dispute or claim arising from or in connection to them or their subject matter, existence, negotiation, validity, termination or enforcement (including non-contractual disputes or claims) shall be governed by and construed in accordance with English Law.

4.2. The Court of England shall have exclusive jurisdiction in relation to any dispute or claims arising out of or in connection with the Rules, their subject matter, existence, negotiation, validity, termination or enforcement (including non-contractual disputes or claims).

TERMS & CONDITIONS FOR BOOKING

1. The Open Banking Expo Awards is an event administered by Open Banking Expo ("OBE"), incorporating an evening awards ceremony. It is scheduled to take place on 15 October 2024.

2. For the purposes of these Terms and Conditions:
(a) the "Event" means the Awards;
(b) "Organiser" means Borough Bench Media (BBM), a company registered in England, company number 09298718, registered address Cromwell House, 15 Andover Road, Winchester, SO23 7BT;
(c)"Delegate" means an individual, whether part of a group or otherwise, by whom (or on behalf of whom) a booking of a place to attend (attendance at) the Event has been made which has been confirmed by the Organiser and where the relevant Registration Fee paid in full (including VAT) to the Organiser (for the Awards);
(d) "Registration Fee" means all monies owing to BBM for attendance at the Awards; and
(e) "Substitution" means any circumstance where a Delegate who has paid in full is unable to attend the Awards, and arranges for another individual to attend the Awards in their place, in agreement with the Organiser.

3. By registering for and/or attending the Event, all Delegates agree to be bound by, and comply with, these Terms and Conditions. It is the Delegate's responsibility to read and understand these Terms and Conditions.

4. In order to attend the Event as a Delegate, participants must pay in full or have paid in full on their behalf the relevant Registration Fee immediately on booking or by the Due Date (see 8 below).

5. The level of the Registration Fee will depend upon whether the Delegate wishes to secure one attendance place at the Awards.

6. The Registration Fee does not include any travel costs, or any costs of accommodation. The Registration Fee relates solely to attendance at the Event. It includes food and refreshments as stated on the Awards website. A vegetarian / vegan / gluten free option will be made available if it is requested at the time of registration. For special meal requests, including kosher or halal, the delegate will be offered an option which will require an additional payment.

7. All Registration Fees must be paid in GB Pounds Sterling (£). BBM prefers payment online via Stripe, our credit card processing partner.

8. If an invoice is requested, payment will be required on the earlier of a) 30 days from the date of invoice and b) sixty days before the start of The Event (the "Due Date"). In all cases, if payment is not received within these required time limits, the Organiser reserves the right to cancel the booking without notice. The invoice payment option is only available for table bookings, not individual tickets. Payment may be made by credit card or bank transfer. When paying by bank transfer, all bank fees and money transfer costs must be prepaid by the transmitter. Please indicate your Invoice Number as a reference on all bank transfers and communications.

9. Details of the Delegate place at the Event will be confirmed by the Organiser once the completed booking is received by the Organiser. Confirmation by the Organiser of the delegate place at the Event forms a binding commitment for payment of the full relevant Registration fees by the delegate.

10. Delegate places at the Event are limited. Places are subject to availability.

11. Bookings are non-refundable, so please ensure you can attend the event before you place a booking.

12. Substitutions can be requested by giving written notice to the Organiser. The Organiser reserves the right to accept or deny a request for Substitution.

13. The Organiser reserves the right to cancel your Delegate place at any time and for whatever reason (including without limitation cancellation of the Event) on repayment of the lesser of the Registration Fee, or if the Registration Fee has not been paid in full, any amount actually received by the Organiser; and this repayment shall be in full and final settlement of any claims against the Organiser by you relating to your Delegate place at the Event.

14. In the event of fire, flood, act of god, pandemic, industrial strike action, or without limit other causes that the Organiser reasonably believes to be substantial or that are beyond the Organiser's control, the Organiser reserves the right to change the times, dates and the venues of the Event, without incurring any liability to you.

15. The Organiser reserves the right, at its sole discretion, to amend or cancel sessions or events at the Event at any time.

16. These Terms and Conditions shall be governed by and construed in accordance with English law and each party irrevocably agrees to submit to the exclusive jurisdiction of the English courts.

17. These Terms and Conditions, together with the registration form, constitute the entire agreement of the parties. In entering into this agreement, the parties have not relied on, and shall have no remedy in respect of, any statement, representation, warranty, understanding, promise or assurance (whether negligently or innocently made) of any person other than as expressly set out in this agreement. Each Delegate shall be deemed to have full knowledge of the Terms and Conditions and shall be bound by them in all respects.

18. These Terms and Conditions may not be modified, amended or rescinded, in whole or in part, except by written amendments signed by both parties.

19. To the full extent allowed by law and insofar as it is reasonable to do so, the Delegate agrees not to hold the Organiser liable for any damage or loss suffered or incurred by the Delegate during the course of the Event, including consequential (i.e. losses which are not incurred as a direct consequence of the event leading to any claim) or indirect losses or loss of profit, through registering for the Event, attending the Event, alteration of the Event schedule, cancellation of the Event, or any error or omission on the part of the Organiser.

20. The Delegate by accepting these Terms and Conditions hereby warrants that he is attending the Event in the course of his or her business and indemnifies the Organiser and its servants and agents against and hold it harmless from all or any loss or damage, injury, actions, proceedings or claims arising from any act or omission of the Delegate during the course of the Event.

21. Delegates are responsible for taking appropriate insurance cover in connection with their attendance at the Event. Where the Delegate is travelling from outside of the United Kingdom to attend the Event, appropriate travel insurance should be purchased independently and in advance of any travel or travel bookings.

22. Any personal information provided as part of the Event registration is used for the purpose for which it has been provided.

23. In the event of inappropriate behaviour by any Delegate in the view of the Organiser or the Event venue operator, the Delegate may be refused entry or asked to leave and excluded from the Event without refund or compensation.

24. Delegates may be asked to undergo reasonable security searches at the Event venue.
